Fryett’s Fabrics successful in beach huts claim

One of the UK’s leading converters and manufacturers of furnishing fabrics Fryett’s Fabrics has successfully settled its copyright claim against Mackays Stores Limited and its supplier Streamline Sales Limited.

Manchester-based Fryett’s has over 60 years of experience in the market and has evolved into one of the leading designers and innovators of curtain and upholstery fabrics. It traditionally supplied wholesalers and converters with their own bespoke ranges and currently supplies retail and manufacturing markets in over 40 countries with its own exclusive collections.

Elements of two of Fryett’s designs Beach Huts and Maritime were copied by Streamline Sales and reproduced in Mackays’ Beach Hut design and advertised on its M&Co website in products including peg bags, oven gloves and seat pads.

Early action by Tony Catterall of Taylors Solicitors meant the case was settled without the need for Court proceedings to be issued and on the basis of undertakings not to import, offer for sale or sell copies of the Beach Huts or Maritime designs. Infringing stock has been destroyed and an agreed sum in respect of damages and costs has been paid to Fryett’s.
